Terms of Service

1. Overview

These Terms of Service govern your access to and use of BuiltRecord. By creating an account, accessing the platform, or using any related features, you agree to these Terms.

2. Nature of the Service

BuiltRecord is a platform for organizing, storing, and managing property-related records and documents. The platform is intended to help users maintain historical and practical records associated with a property, but it is not a substitute for professional architectural, engineering, construction, legal, insurance, code, or permitting advice.

BuiltRecord is intended only for property-related records and associated documentation reasonably connected to the management, history, maintenance, transfer, or understanding of a property.

3. Eligibility and Account Security

You must provide accurate account information and maintain the security of your login credentials. You are responsible for activity occurring under your account, except to the extent caused by our own unauthorized access or misconduct. You must promptly notify BuiltRecord if you believe your account or credentials have been compromised.

4. User Responsibility for Uploaded Content

You are solely responsible for the files, records, notes, tags, addresses, and other content you upload, submit, store, or share through BuiltRecord.

You represent and warrant that, to the extent applicable:

• you own the content you upload, or have sufficient rights, permissions, and authority to upload, store, use, and share it through the platform;
• your use of the platform does not violate applicable law, contract terms, confidentiality obligations, privacy rights, or intellectual property rights;
• you will not use the platform to unlawfully distribute, resell, exploit, publish, or make available protected drawings, records, or related materials;
• you understand that uploaded records may include sensitive property-related information, and you are responsible for determining whether you have the right to upload and share such materials.

5. Limited Platform License

You retain your rights in content you upload, subject to any rights held by third parties. By uploading content to BuiltRecord, you grant BuiltRecord a limited, non-exclusive, revocable license to host, store, process, organize, display, reproduce, and transmit that content solely as reasonably necessary to operate, secure, maintain, and improve the service for you and any access permissions you authorize through the platform.

This license does not transfer ownership of your content to BuiltRecord and does not authorize BuiltRecord to sell your uploaded content, publicly distribute it outside the service, or use it for unrelated commercial exploitation.

6. Intellectual Property and No Reuse Rights

BuiltRecord does not claim ownership of third-party drawings, plans, specifications, or other materials uploaded by users. Storage of such materials on the platform does not transfer copyright, design rights, or reuse rights to BuiltRecord, to other users, or to any recipient of shared access unless expressly authorized by the applicable rights holder.

Access to records through the platform does not by itself grant permission to copy, construct from, replicate, modify, publish, distribute, or commercially exploit any design, drawing, or protected material.

7. No Guarantee of Accuracy or Completeness

Property records, historic drawings, uploaded files, derived metadata, and related information may be incomplete, outdated, mislabeled, inaccurate, or inconsistent with actual site conditions. BuiltRecord does not guarantee that any content on the platform is accurate, complete, current, buildable, code-compliant, permit-ready, or suitable for any design, construction, pricing, legal, insurance, or operational decision.

You are responsible for obtaining appropriate field verification and professional review before relying on any records for real-world action.

8. Prohibited Uses

You agree not to:

• use the service for unlawful, infringing, fraudulent, abusive, or deceptive activity;
• upload content you do not have the right to store, access, or share;
• upload content that is unrelated to property records or the intended use of the service;
• upload or store sexually explicit, obscene, exploitative, or pornographic content;
• upload or store content involving threats of violence, extremist activity, terrorism-related content, or instructions, communications, or materials intended to facilitate serious harm;
• upload or store harassing, hateful, abusive, or threatening content;
• upload spam, malicious, deceptive, or irrelevant materials that interfere with the intended use of the platform;
• attempt to misuse, disrupt, probe, or bypass platform security or access controls;
• scrape, extract, or republish content from the platform without authorization;
• use stored documents as a substitute for proper field verification, permitting, or professional review.

9. Property Transfer, Record Transfer, and Sharing

BuiltRecord may allow users to transfer properties, and records associated with a transferred property may transfer together with that property within the platform’s data model and workflows.

Any such transfer, access grant, or sharing action is limited to the permissions, workflows, and technical controls made available through the platform. BuiltRecord does not independently verify whether a user has the legal authority to transfer, share, or grant access to any property-related records, and users are solely responsible for ensuring that any such action is authorized and lawful.

10. Suspension and Removal

BuiltRecord may suspend or terminate access, remove, disable, screen, or restrict content or accounts when reasonably necessary to address misuse, suspected infringement, confidentiality concerns, legal claims, security risks, platform abuse, spam, unrelated content, sexually explicit content, violent threats, extremist or terrorism-related content, or threats to service integrity.

Where appropriate, BuiltRecord may investigate complaints and may request additional information before restoring content or account access.

11. Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. BuiltRecord disclaims warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, BuiltRecord will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, business opportunities, or property-related loss arising out of or related to the use of, or inability to use, the service.

To the maximum extent permitted by law, BuiltRecord’s total aggregate liability for all claims arising out of or relating to the service will not exceed the greater of (a) the amount paid by you to BuiltRecord for the service during the 12 months preceding the event giving rise to the claim, or (b) a modest fixed cap to be finalized in a later legal review.

13. Indemnification

You agree to defend, indemnify, and hold harmless BuiltRecord and its affiliates, operators, and service providers from and against claims, liabilities, damages, judgments, losses, and reasonable expenses arising out of or related to:

• your uploaded content;
• your misuse of the service;
• your violation of these Terms; or
• your violation of any law, contract obligation, confidentiality duty, privacy right, or intellectual property right.

14. Changes to the Terms

We may update these Terms from time to time. When we do, we may revise the “Last updated” date above and take additional steps as appropriate depending on the significance of the changes.
